Ganshi Delivery herein, will be referred as GANSHI throughout this document is an online delivery company and the following are the terms and conditions of GANSHI to our customers / consumers / users. This document is an electronic record in terms of The Information Technology Act, 2000 ("IT Act") and rules thereunder, and is published in accordance with the provisions of Rule 3 (1) under IT Act which mandates for publishing of rules and regulations, privacy policy and terms of use for access or usage of the Website and application. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Your use / access of the Website and application, its related sites and hyperlinks, shall be governed by the terms and conditions, policies, rules of GANSHI ("Terms") posted on the Website and application from time to time. These Terms applies to all users (whether Registered user or Guest User) of the Website and application.

By subscribing to or using the website and application or any of our services through the Website and application you agree that you have read, understood and are bound by the Terms, Policies, directions of GANSHI regardless of how you subscribe to or use the Website and application. This Agreement comes into effect upon your "Acceptance" of these terms and conditions ("Terms") however GANSHI at its sole discretion reserves its right not to accept a user from registering on the Website and application without assigning any reason thereof.

MEANING

Agreement means the terms and conditions as detailed herein including all schedules, appendices, annexures, Privacy Policy, Disclaimer and will include the references to this Agreement as amended, novated, supplemented, varied or replaced from time to time.

"You"/ "User" shall mean the end user accessing the Website and application, its contents and using the facilities offered through the Website and application.

"GANSHI”/ "we"/ "us"/ "our" shall mean Ganshi Delivery or its associates, franchisees, facility providers, inheritors and assigns "Site" means the online shopping platform owned and operated by GANSHI, which provides a venue to the users to buy the Products listed on this Site.

"Customer"/"Buyer" shall mean the person or any legal entity who access the Website and application and places an order for and or purchases any products /facilities against the invitation of offer for sale of products / facilities on the Website and application.

"Acceptance" shall mean your assenting action in clicking on "check box" and on the "continue button as provided on the registration page or clicking on

"Pay" button while transacting as User or such other actions that implies your acceptance.

"Product" shall mean the Products offered for sale on the website and application from time to time

"Delivery" shall mean the physical delivery of goods under your order placed with us

"Price" means the price communicated at the time of order and confirmed by us

"Payment Facility" shall mean applicable mode of payments made available to User from time to time.

“Out of Stock” shall mean products listed in the site is unavailable to make an order / purchase

As part of the registration process on the Site, GANSHI may collect the following personally recognisable information about you: Name including first and last name, email address, mobile phone number and contact details, Postal code, Demographic profile (like your age, gender, occupation, education, address etc.) and information about the pages on the site you visit/access, the links you click on the site, the number of times you access the page and any such browsing information.

ELIGIBILITY

Facilities of the Site would be available to only select geographies. Persons who are "inept to contract" within the meaning, 1872 including un-discharged insolvents etc. are not eligible to use the Site. If you are a minor i.e., under the age of 18 years but at least 13 years of age you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your age is below 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption and the sale of which to minors are prohibited.

ACCOUNT & REGISTRATION OBLIGATIONS

All shoppers / users have to register and login for placing orders on the Site. You have to keep your account and registration details current and correct for communications related to your purchases from the site. By agreeing to the terms and conditions, the shopper / user agrees to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in "My Account" or by contacting the customer service. 

As a Registered User, you are responsible for maintaining the confidentiality of your user id and password. You are also responsible for maintaining the confidentiality of your email id and mobile number and for any unauthorised access to your mobile, tab, computer, computer system and computer network, and you are responsible for all activities that occur under your user id and password, email id and mobile number as the case may be. You agree to maintain and promptly update all data provided by you and to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the Terms, we have the right to indefinitely suspend or terminate or block access of your user account with the Website and application and refuse to provide you with access to the Website and application.

LICENSE & SITE ACCESS

The User hereby confirms that the information provided by him / her is true, correct and complete to the best of his / her knowledge and belief. The User agrees and understands that he / she will be solely responsible in the event of any inaccuracy or deviation therefrom at a later stage.

You agree to comply with all applicable laws in connection with your use of the Website and application, and such further limitations as may be set forth in any written or on-screen notice from us.

To register with & shop with GANSHI you must be thirteen years of age or over. Our website and application are not directed to children under the age of 13. If we become aware that a child and/ or customer is under the age of 13 and has registered or using our Website and application, we are entitled to remove his or her account from our system and cancel any order placed by him or her. Minors between age 13 and under 18 shall use the site under the supervision of their Parents / Guardians. However, the minors are not allowed to buy any products which are for adult consumption.

You agree and undertake not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website and application. Reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the Website and application is not permitted

You agree and undertake not to display, upload, modify, publish, transmit, update or share any information that:

Belongs to another person and to which you do not have any legal right

is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner what so ever;

Harm minors in any way;

Infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy;

Violates any law for the time being in force;

Impersonate another person

Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information.

You, as a Buyer, understand that upon initiating a transaction you are entering into a legally binding and enforceable contract with GANSHI to purchase the products and /or facilities from GANSHI, and pay the transaction price to GANSHI using appropriate Payment Facility. You, as a Buyer, understand that the all-payment facility may not be available in full or in part for certain category of products and for certain locations and hence you may not be entitled to use that Payment Facility in respect of the transactions for those products or locations.

PRICING

All the products listed on this site will be sold at a special price in contrast to the Market price. GANSHI sells the products / items (that includes Vegetables, Fruits, Pulses, Cereals, Milk, Meat etc.) at a relative margin between 10% to 40% less than the market price to ensure the benefitto our Users / Customers / Shoppers. Prices of products / items listed at GANSHIwould differ day by day in divergence to the market however, users ordering items / products from GANSHI in a day with GANSHI’s listed price shall remain the same until that particular order gets delivered to that user. No additional costs shall be levied to the users in-case, if excess quantity of a product / item is weighed more than the actual weight displayed in the GANSHI website / application.

CANCELLATION, RETURNS AND REFUNDS

You, as a Buyer, shall not be permitted to cancel your order. Buyer orders placed shall be delivered to the buyer within the promised delivery date. No refunds shall be provided once order is successfully placed by a buyer / user.

Returns are not accepted at GANSHI. However, users / buyers shall return the parcel, if the delivery Package is / are damaged while delivering the order or if the order number or buyer name or address is not matched with the buyer / user. If soft vegetables like tomatoes gets squeezed out during delivery,thoseshall be refunded, provided with suitable proof to be submitted by the buyer / user to GANSHI.

If the Buyer / User are not available during the time of delivery, they can request to reschedule in the same day only. Failing to do so, GANSHI shall not deliver the order nor would refund. If the buyer / user wishes the order to be delivered to a different address, they should write a request e-mail from their registered email ID with the order number & Name and send it to support@Ganshi Delivery before the delivery date. Orders shall be delivered only at the registered address of a buyer / user in their doorsteps only.

In event of any natural calamities / government-imposed lock-down, GANSHI shall cancel or modify the order to a newer date or issue a partial / full refund subject to the sole discretion of GANSHI’s management. In event of unavailability of an item / product, GANSHI shall issue refund to the corresponding item /product ordered by the Buyer.

MODIFICATION OF TERMS & CONDITIONS OF SERVICE

GANSHI may at any time modify the Terms & Conditions of Use of the Website without any prior notification to you. You can access the latest version of these Terms & Conditions at any given time on the Site. You should regularly review the Terms & Conditions on the Site. In the event the modified Terms & Conditions is not acceptable to you, you should discontinue using the Service. However, if you continue to use the Service you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions of Use of this Site.

GOVERNING LAW AND JURISDICTION

This User Agreement shall be construed in accordance with the applicable law. The Courts at shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by GANSHI and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in. The District Court of judicature alone shall have the jurisdiction and the Law shall apply.

DELIVERY / DISTRIBUTION POLICY

GANSHI will make every effort to get your order delivered to you as per the slot you choose that is made available to you at the time of ordering

1. The products ordered by You shall be available for delivery as per allotted delivery slot during the delivery hours, namely, 07:30 hours to 21:30 hours only on Thursday, Saturday & Sunday. If you fail to take delivery on the agreed slot as mentioned in (a) above, your order and delivery thereof shall be treated as cancelled. However, if you’ve informed GANSHI through email about the change of delivery time / location before “out for delivery” status update, GANSHI will ensure to deliver the items accordingly.

2. The person at the Delivery Point authorized to deliver the product may decline to deliver the product if he finds any inconsistency as regards Order No. or any other detail of the order

3. Subject to availability of the ordered product at the Delivery Point on the delivery day, GANSHI shall deliver the product to You as per schedule, failing which GANSHI shall / shall not inform You with a revised schedule for delivery of the Product. You may ask for modification of Order on account of this.

4. It is your responsibility to count and check all the products while accepting the Products as per your Order. No dispute will be entertained by GANSHI once you accept the products at the Delivery Point.

5. You shall accept the product without protest in the following circumstances:

a. If the products delivered to you are in accordance with your order, or

b. Loose Fruits and Vegetables with minor weight variation due to moisture loss

We request you to check all the Products at the time of delivery. Complaint pertaining to short weight will not be entertained, if the complaint is not lodged immediately on delivery.

INDEMNITY

You agree to defend, indemnify and hold harmless GANSHI, its employees, directors, officers, delivery agents, and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to GANSHI or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfilment of any of your obligations under this User Agreement or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement.

Harassing or ill-treatment of GANSHI’s employees, directors, officers and delivery agents will result a user / buyer to face severe legal consequences and their account shall be suspended and will not be entertained by GANSHI.

BUYER PROTECTION

As a user / buyer your information is protected at GANSHI and GANSHI will not share your details to any third parties or organisations.

GANSHI do not ask for your debit / credit card / UPI / Net banking details to be stored with us nor for any validation reasons. If any email or call received pertaining to furnish those confidential details, Users / Buyers shall report it to GANSHI through email / helpline number and GANSHI shall take strict actions against such fraudulent activities.

User’s / Buyer’s payment transactions are secured through Razor Pay’s payment gateway and GANSHI deems no right if any impeachment is caused at Razor Pay’s payment gateway.

If any amount is debited to a user / buyer while placing an unsuccessful order, it shall be returned to the corresponding user / buyer within 48 working hours.

At GANSHI, we treat our Users / Buyers at utmost respect and if any user / buyer is illtreated by GANSHI’s employees ordelivery agents, User / Buyer shall report it to GANSHI regarding the same and GANSHI shall necessarily take actions against the faulty employees or delivery agents and ensure no such horrendous event would take place in the future.

TERMINATION

User Agreement shall be effective form the date and time of your acceptance of the Terms of the Website and application and remain in force unless and until terminated by either of us. You may terminate this Agreement at any time, provided that you discontinue any further use of this Site. We may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, such termination will be without any liability to us. Upon any termination of the User Agreement by either of us, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the User Agreement or otherwise. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Site or affect any liability that may have arisen under the User Agreement.

This Website and application provide Content without any warranties or guarantees and in an "As Is" and "where is" basis. You must bear the risks associated with the use of the Site. This Website and application provide content from other Internet sites or resources and while GANSHI and its software support service provider tries to ensure that material included on the Website and application is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. GANSHI and its affiliates shall not be held responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Website and application. GANSHI, its affiliates or its associates and technology partners make no representations or warranties about the accuracy, reliability, completeness, correctness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Website and application or that the operation of the Website and application will be error free and/or uninterrupted. Consequently, GANSHI and its affiliates/associates assumes no liability whatsoever for any monetary or other damage suffered by you on account of the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Website and application; and/or any interruption or errors in the operation of the Website and application.
